Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of PicSquish (“the App”), a desktop application developed and published by Carr Restoration Ltd trading as Mega Baboon Labs (“Mega Baboon Labs”, “we”, “us”, “our”). By purchasing, downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Free trial

PicSquish offers a free 14-day trial with full access to all features. No payment details are required to start the trial. The trial period begins when you first launch the App and expires 14 days later. After the trial period, a valid licence key is required to continue using the App.

Each trial is limited to one per device. Reinstalling the App or creating new user accounts to extend or restart the trial period is not permitted.

3. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on computers that you own or control, for personal or commercial purposes, subject to these Terms and a valid licence key. You may not redistribute, sublicence, rent, lease, or lend the App or your licence key to third parties.

4. Purchase and payment

PicSquish is a paid application. Payment is processed by our authorised reseller, Paddle.com Market Limited. By completing a purchase, you also agree to Paddle’s Terms of Use and Privacy Policy. Paddle handles all payment processing, invoicing, VAT/sales tax collection, and compliance as the Merchant of Record.

Upon purchase, you will receive a licence key via email. This key activates the App and must be entered to continue using PicSquish after the trial period.

5. Licence validation

PicSquish validates your licence key locally on your device. No internet connection is required for activation or continued use, and no licence data is transmitted to any server. Your licence key is stored in your local application preferences and is checked only on your device.

6. Refunds

Because PicSquish offers a free 14-day trial, you have the opportunity to fully evaluate the App before purchasing. If you are not satisfied after purchase, you may request a refund within 30 days by contacting us at picsquish@proton.me. Refunds are processed by Paddle in accordance with their refund policies and applicable consumer protection laws.

7. Updates

Your purchase includes all future updates to the current major version of PicSquish at no additional charge. We may release updates that fix bugs, improve performance, or add features, but we are not obligated to provide any specific updates or continued development.

8. Restrictions

You may not: (a) reverse-engineer, decompile, or disassemble the App except where permitted by applicable law; (b) remove or alter any copyright, trademark, or proprietary notices; (c) use the App for any unlawful purpose; (d) distribute modified versions of the App; (e) share, publish, or transfer your licence key to any third party; or (f) attempt to circumvent or tamper with the licence validation mechanism.

9. Intellectual property

PicSquish, including its design, code, icons, and documentation, is the intellectual property of Mega Baboon Labs and is protected by copyright and other intellectual property laws. Your purchase grants a licence to use the App — it does not transfer ownership of any intellectual property.

All images and files you process with PicSquish remain entirely yours. We claim no rights over your content.

10. Third-party components

PicSquish includes open-source image codec components for supported formats such as AVIF and WebP. These components are used under their respective open-source licences and process images locally on your device.

11. Privacy

PicSquish does not collect, transmit, or store any personal data. Image processing happens locally on your device. For full details, see our Privacy Policy.

12. Disclaimer of warranties

PicSquish is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.

Nothing in these Terms excludes or limits any statutory rights that cannot be excluded or limited under applicable law, including UK consumer protection laws.

13. Limitation of liability

To the maximum extent permitted by applicable law, Mega Baboon Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the App. Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the App.

14. Termination

We may terminate or suspend your licence if you breach these Terms, including but not limited to sharing your licence key or attempting to circumvent licence validation. Upon termination, your licence key will be revoked, you must cease all use of the App, and delete all copies. Sections 9, 12, 13, and 15 survive termination.

15. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page and publish the revised Terms here. Continued use of the App after changes constitutes acceptance of the updated Terms.
